Dear Class Members:
We are continuing our settlement discussions with Toshiba. Though the matter did not resolve at last month's mediation, we are engaged in an ongoing dialogue with Toshiba.
The Status Conference, which had been set for January 13, 2004, has been continued to February 19, 2004. During the next four weeks, we will continue to explore whether Toshiba is prepared to make a settlement proposal we can support and, ultimately, recommend.

Description of Case
Kiesel, Boucher & Larson, LLP. represents a putative class of
consumer purchasers of Toshiba Satellite® 5005-S504 and/or 5005-S507 portable
notebook computers.
This consumer class action was filed on July 23, 2002 in the California State
Court of the Superior Court of Los Angeles County. The Complaint alleges that
these Toshiba computers, which were promoted by Toshiba as “The Ultimate
Multimedia machine” and as offering 1.1GHz Pentium III processing power,
actually fail to perform at their advertised speed of 1.1GHz because they overheat
and shut down.
The Complaint alleges that Toshiba has literally failed to address hundreds of
consumer complaints concerning this issue. The Complaint further alleges that,
although Toshiba has offered customers two attempted software “fixes,”
those fixes were unsuccessful, because they can only stop the computers from overheating
by slowing down the computers’ processing speed to substantially lower than
advertised levels.
Toshiba began marketing and selling the Satellite 5005-S504 in October 2001 and
the Satellite 5005-S507 in February 2002.
